Infant Killed After Erractic Driving by Dah Man in Amarillo, Texas
According to local reports, an infant is dead following a single-vehicle
accident in Amarillo, Texas. The accident occurred around 4:40 p.m.
Tuesday, August 30 when 30-year-old Dah Man lost control of his vehicle,
veered into oncoming traffic and into an embankment. One of Man's
passengers, two-month-old Dae Da One was killed as a result of injuries
sustained from the accident. One passenger was treated and released from
Northwest Texas Hospital, while one was listed in stable condition. Man
was in serious but stable condition, also at Northwest Texas Hospital.
Police believe Man was driving drowsy and the infant was not properly
strapped into the car seat.
Commentary I offer
my condolences to the family in this tragic accident. An independent
investigation is needed to flesh out statements made by police and the
news reports. If the reports are accurate and the man was driving
drowsy, he could face liability in a wrongful death claim by the mother
of the infant. Furthermore, if the infant was not properly restrained,
this could be viewed as a negligent act by the driver. Parents and
guardians have a responsibility to ensure the safety of minors, and
especially infants. The lack of proper restraint coupled with the
erratic driving breaches this responsibility. Because an infant passed
away, certain damages like loss of income or financial support do not
apply in a wrongful death claim, but funeral costs and pain and
suffering certainly do.
