Passenger Lucas Peterson Killed in Suspected Drunk Driving Accident in Viroqua, WI
According to local reports, a man was killed and another arrested following a rollover accident in Viroqua, Wisconsin. The accident occurred around 3:00 a.m., Sunday August 28 when 23-year-old Robert Buckles lost control of his vehicle, crossed over a center median, struck a fence and rolled his vehicle three times. Buckles' passenger, 29-year-old Lucas Peterson was killed at the scene. Buckles sustained only minor injuries. The Vernon County Sheriff's Department believes alcohol played a part in the accident.
Commentary This is a senseless tragedy at the hands of an alleged drunk driver. While a third party investigation is needed to determine liability, if that examination determines the man was intoxicated prior to the accident, he could assume great liability in a wrongful death claim. This liability stems from when a driver decides to drink and drive, this act is deemed one of recklessness. Not only disregarding their own safety, drunk drivers disregard the safety of every motorist on the roadways. Unfortunately, a wrongful death claim may be the only course of action in this terrible accident. Many states have recourse to make a claim against a bar or restaurant that is found to over-serve their patrons. In states possessing dram shop laws, these establishments can be found partially liable in the event one of their customers is found intoxicated and involved in an accident. Wisconsin, however, does not hold dram shop laws for adults, and these establishments only hold licensing restrictions in the obvious claim against minors.
