Commentary Drunk
driving is becoming an epidemic across the nation. While a third party
investigation is needed, if this man was indeed driving drunk, he could
face great liability in a wrongful death claim. When a motorist decides
to drink and drive, they not only endanger themselves on the roadway,
but everyone else as well. In a normal drunk driving accident, the
police report will provide most of the evidence needed for a wrongful
death claim, but the investigation is needed to identify third parties
who could potentially be liable. For example, Illinois has in place what
are known as dram shop laws. These laws attempt to hold alcohol-serving
establishments partially accountable if one of their patrons is
over-served and is involved in a wreck. The laws in no way attempt to
remove fault from the driver, but rather seek to enforce the laws
required to be licensed to sell liquor. If the man was found to be
drinking at a bar or restaurant prior to the accident, it is possible
that entity could face partial liability. This is just one route
legislators have identified in attempting to stop the cause of many of
these accidents.
