Anousone Phanthavong Killed in Hit-and-Run Accident in Minneapolis, Minnesota
According to local reports, a man was killed less than one mile from his work after putting gas into his car on the shoulder of a roadway in Minneapolis, Minnesota. The accident occurred around 11 p.m. when 38-year-old Anousone Phanthavong was struck near Riverside Avenue and Interstate 94, Tuesday August 23. The unidentified driver then fled the scene.
Commentary Hit-and-run drivers represent some of the lowest defendants my firm encounters. An independent investigation is needed to determine liability once the driver is found. Typically, hit-and-run motorists have something other than the accident to hide from authorities. In many instances, these drivers fear a possession charge or possible DUI. Regardless of these contingencies, if the police reports are accurate and the pedestrian was lawfully in the shoulder with his disabled vehicle, the hit-and-run driver could face fault in a wrongful death claim. Drivers have a responsibility to operate safely with regard to disabled vehicles in the shoulder of a roadway. It would appear this responsibility was breached in this tragedy.
