Mario Andres Castillo Avena Killed Following Tractor Accident in Rockingham County, North Carolina
Local reports indicate a man was killed after his tractor somehow veered
off the road into a ditch in rural Rockingham County, North Carolina.
The accident occurred around 8 a.m. August 25 when 25-year-old Mario
Andres Castillo Avena was pulling a trailer with his tractor, when it
ran down an embankment killing the man. North Carolina Highway Patrol
are investigating the accident.
Commentary Details
are certainly minimal at the moment but this is a terrible situation. A
third party investigation is needed to determine liability. Now, many of
you may be wondering where there could be liability in a single-vehicle
one-person accident. In my 20+ years experience, I can tell you it is
not uncommon for mechanical failure to be one of the causes of these
types of accidents. This type of failure could open a manufacturer to a
wrongful death claim. This is why I suggested the investigation. Highway
Patrol are excellent at what they do (and make no mistake about it, we
are on the same side) but they are not trained to detect product defects
or mechanical failures that are attributable to an accident. This can
really only be accomplished with an expert leading the examination. Some
of you may think this is an unnecessary long-shot, but I would take
caution in a statement like this when the family is unaware of what
actually happened to their loved one.
