Pedestrian Killed Following Minor Wreck in Fremont, California
According to local reports, a 47-year-old man was killed following a minor accident in Fremont, California. The accident occurred around 9:30 a.m. when the man was involved in a minor incident on Interstate 680 and pulled off the freeway to exchange information with the other motorist. During this time, an 83-year-old man drove onto the sidewalk of the street and struck the man. Officers found the victim pinned under the car and the elderly man unconscious.
Commentary This is an unfortunate accident. A third party investigation is needed to determine liability in this matter. If the elderly man was driving with a known condition that could harm his ability to effectively operate a vehicle, he could potentially face fault in this matter. Furthermore, the investigation should check the mechanical components of the man's vehicle. My firm has litigated several cases where the cause of an accident is a faulty component like a braking relay. These types of accidents are more common than you think, and could bring a third party like the manufacturer of the part/vehicle into a wrongful death claim.
