Ignacio Ramirez Charged With DUI in Fatal Collision with Bicyclist in Chicago, IL
According to local reports, 38-year-old Ignacio Ramirez allegedly drove drunk and struck a bicyclist early Tuesday, August 23. The accident occurred around 12:52 a.m. in the 1100 block of West 18th Street in Chicago, Illinois. Police believe the unlicensed motorist ran a stop sign before striking the man. Authorities say Ramirez then fled from the scene but was later arrested.
Commentary When drivers choose to drink and drive, they not only endanger themselves on the roadway but also every other motorist. While an independent investigation is needed for liability purposes, if the man was indeed found to be intoxicated prior to the accident, he could face great fault in a wrongful death claim by survivors of the victim. Additionally, if the investigation were to find the man had been drinking at a bar or restaurant prior to the wreck, there could be a third party claim involved as well. Illinois has in place what are called dram shop laws that could hold an alcohol-serving establishment liable in the event they over-serve a patron and that patron is involved in an accident. These laws do not attempt to remove fault from a drunk driver but rather hold bars or restaurants accountable for the rules they agreed to abide by to obtain a legal liquor license.
