Matthew Denice Killed by Suspected Drunk Driver Nicholas Guaman in Milford, Massachusetts
According to local reports, a man was killed after a suspected drunk driver ran a stop sign and struck his motorcycle in Milford, Massachusetts. The accident occurred around 7:45 p.m. Saturday, August 20 when 34-year-old Nicholas Guaman ran the sign and struck 23-year-old Matthew Denice. Witnesses state the victim became stuck in Guaman's wheel well, causing the man to be dragged for approximately a quarter of a mile.
Commentary Even if alcohol was involved, it is very difficult to understand how a vehicle drags a man for that length. To begin, a third party investigation is needed to determine all liability. Certainly if the man was found to be driving intoxicated, he could face liability for the accident, and a potential wrongful death claim. What's more, Massachusetts has in place what are called dram shop laws that could place liability upon a bar or restaurant if the defendant was found to be imbibing there prior to the wreck. It is now being reported this man may be an illegal immigrant, so I would also like to mention the running theory I hear occasionally that claims cannot be made against them. This is simply not true. Legal immigrant status affords certain things and others it does not. Furthermore, litigation in other states is beginning against certain authorities who fail to deport a known immigrant who causes an accident or commits a crime.
