Commentary A fatal injury on the job is a terrible thing. A third party investigation is needed to determine liability in this accident. While police do not believe intoxicants played a part in this accident, simply being distracted while driving could hold a person liable in an incident. A wrongful death claim typically needs only 4 elements: a liable party whose actions or inaction contributed to the accident, negligence, survivors of the victim, and proof that the decedent or survivors have incurred some degree of financial loss as a result of the accident. My firm has litigated dozens and dozens of cases where a pedestrian is struck by a driver, and typically these four elements are relatively easy to uncover.
