Donna Searles Killed by Suspected Drunk Driver in Gobles, Michigan
According to local reports, a motorcyclist was killed after a head-on collision with a suspected drunk driver near Gobles, Michigan, Sunday August 21. Police state 46-year-old Donna Searles was killed on County Road 388 when a suspected drunk driver crossed over the center line of the road and struck her motorcycle. The 27-year-old driver was leaving a blueberry farm where he had been drinking when the accident occurred. The driver, who has yet to be identified, was driving at twice the legal blood alcohol limit and driving without a license, according to police.
Commentary I really feel for the family of the victim involved. Not only are they struggling with the accident, but to not be able to identify the defendant in this matter is torturous. A third party investigation is needed in collaboration with the police report to identify the defendant and determine liability. Certainly the obvious claim here is one of wrongful death against the driver, unfortunately though, Michigan's laws may prevent the inclusion of a third party that the news feed seems to implicate. In other states like Texas, there could be a potential claim against the property owner if they had knowledge of this kind of reckless behavior occurring on their property.
