John McNamara Sentenced in High Speed Fatal Auto Accident That Killed Abby Cockrill in Platte City, MO
According to recent news reports from Platte City, Missouri, 27-year-old John McNamara pleaded guilty to involuntary manslaughter in January for a high speed fatal car accident that claimed the life of 22-year-old Abby Cockrill, of Platte City, on Aug. 22, 2010. McNamara received a sentence on Thursday, March 10, of 17 years in prison for driving with a blood alcohol content level of .171 and attaining speeds up to 152 miles-per-hour resulting in a fatal auto accident. McNamara was driving on I-29 near Platte City when he struck the rear of the car that Cockrill was riding in. It was reported that McNamara struck the car going 131 miles-per-hour.

The details of this unfortunate accident are almost unbelievable considering the incredibly high speeds mentioned. When drinking and driving combine to cause a fatal auto accident, a driver can be held civilly liable for their negligent driving, regardless of the criminal charges also brought against such a driver. Furthermore, Missouri dram shop law may apply in instances where a bar or restaurant over-serves alcohol to a person prior to a drunk driving accident.
