Denise Polinchak Killed, Struck by Own Car in Tow Truck Driver Accident in Plains Township, PA
According to recent news reports from Plains Township, Pennsylvania, 55-year-old Denise Polinchak, of Wilkes-Barre, died on Tuesday, March 8 after a car accident the previous day. Polinchak called for a tow truck after having problems with her car in a parking lot of a Social Security Administration building. A tow truck driven by Robert Wickham, 55, of Dallas, arrived in the parking lot. Reportedly, Wickham reversed Polinchak's car with the driver's side door open. The door hit Polinchak and she had to be taken to a hospital. She succumbed to her sustained injuries the following day. Police reported that Wickham smelled of alcohol, so he was arrested and given a blood test. No charges have been filed in connection to this accident, but an investigation is continuing.

Should the investigations find that the tow truck driver bears liability for this tragic and sudden accident, both the driver and his employer can be held civilly liable for the consequences of such alleged negligent behavior. Furthermore, if alcohol may have played a contributing role to this fatal auto accident, Pennsylvania dram shop law may apply should the alleged negligent driver have been over-served alcohol at a bar or restaurant prior to this incident. If such a chain of events led up to this unfortunate accident, an alcohol-serving establishment may also bear liability for the results of the incident. Regardless of what may have occurred, an independent investigation can look into what actually occurred so that each liable party can be both identified and held accountable for their negligent behavior resulting in such a devastating outcome.

on the polinchak case, I was a AAA tower and have info that AAA Mid Atlantic does not do enough to ensure the towers they send are trustworthy and safe, there is a tower here that has been kicked off Police lists and has no insurance but AAA Mid atlantic keeps him on and lets me go all to a bonus program they do not want to correct...
