One Woman Dead in One-Vehicle Fatal Auto Accident in Oregon
According to recent news reports from Oregon, a 20-year-old woman has died after being ejected from the back of a car that struck a cement barrier after veering off of Broadway Brige around 5:30 a.m. on Sunday, Dec. 26. The woman was a passenger in a car driven by Andres Guillermo Escobedo, 20. She was pronounced dead at the scene of the accident. A 17-year-old female was also a passenger and experienced non-life-threatening injuries. She was taken to an area hospital. A male passenger fled the scene and has yet to be apprehended or identified. Escobedo was taken to an area hospital with serious injuries. He faces charges of driving under the influence of intoxicants, reckless driving, and second-degree manslaughter.
When fatal auto accident occur that were possibly caused by the use of alcohol, Oregon dram shop law may apply. Generally speaking, dram shop laws throughout the U.S. (though not all states have dram shop laws) are used to hold negligent alcohol-serving establishment accountable for their negligent behavior in regards to their patrons' safety and the safety of the general public. In other words, if the alleged intoxicated driver had been drinking at a bar and was over-served, then caused a drunk driving accident, the bar could be held partially liable for the wreck causing injury and loss of life. It should also be noted that the alleged drunk driver can bear civil liability for the accident, in addition to any criminal charges he may be facing. An independent investigation may be conducted in order to ascertain if another entity, like a bar or restaurant, may have been involved so that all liable parties can be held accountable for their actions.
