On May 26, 2008Colbert Sanders was killed after being struck by two hit-and-run drivers. A note from E. Michael Grossman:
I have noticed an alarming trend of hit-and-run accidents lately. It is very frustrating to know that people can be so careless. Many people are under the impression that if someone is injured or killed by a driver who is summarily arrested (i.e. a drunk driver or a hit-and-run driver) that there is no way that a wrongful death or personal injury claim can be made, based on the notion that the guilty party is already in jail.
That is not the case. The criminal matter is separate from the civil matter. Although the guilty party is in jail a wrongful death or personal injury claim can still be made against them or against their insurance company. There are many factors to consider and many different avenues to pursue which is why hiring an attorney with a great deal of experience in the matter is the best way to go.
